What is “specialized knowledge” for an L-1 visa?

Specialized knowledge is special knowledge you hold about your company’s products, services, research, equipment, techniques, or management and how the company uses that knowledge, including in international markets. It is more than ordinary expertise, it does not have to be proprietary, and the job itself must require it.

The L-1B visa is for employees with specialized knowledge. The L-1A is for managers and executives who do not need to meet this test.

What are the two parts to specialized knowledge?

Specialized knowledge has two parts.

First, the knowledge itself. It is special knowledge you possess relating to the organization’s product, service, research, equipment, techniques, management, or other interests, and how that knowledge applies to international markets for the organization. It can also be an advanced level of knowledge of the company’s processes and procedures which are more developed, complex, or advanced than what is generally found in the organization or commonly known in the industry.

Two points are easy to miss. Specialized knowledge is more than expertise: the knowledge must relate to the organization and to how the organization uses it, not just to your general skill in a field. And it does not have to be proprietary and the knowledge can be specialized even if it is not secret.

Second, the position. To qualify as a specialized-knowledge worker, the role itself must require that knowledge. It is not enough that you happen to possess it; the job must depend on it.
